Terms of Service
DTC Fitness, LLC
Effective date: October 9, 2026
These Terms of Service ("Terms") are an agreement between you and DTC Fitness, LLC ("DTC Fitness", "we", "us") and govern your use of the DTC Fitness mobile app (the "App") and dtcfitness.com (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Please read §14 carefully. It requires most disputes to be resolved by individual binding arbitration and waives class actions and jury trials, unless you opt out as it describes.
1. Health and safety
The Service is a training log, not medical advice. Workouts, programs, exercise demonstrations, statistics, and any other content in the Service are for general information only. They are not a substitute for advice from a physician or other qualified professional, and they are not tailored to your health.
- Consult a physician before starting any exercise program, especially if you are pregnant, have a medical condition, take medication, or have been inactive.
- Stop exercising immediately and seek medical help if you feel pain, dizziness, faintness, or shortness of breath.
- Use proper form, appropriate loads, a spotter where needed, and equipment in good condition.
Exercise carries an inherent risk of injury. You choose whether, how, and how hard to exercise, and you do so voluntarily and at your own risk. To the fullest extent the law allows, you assume all risk of injury, illness, or death arising from exercise you do in connection with the Service.
2. Eligibility and accounts
You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian, who agrees to these Terms on your behalf. The Service is not offered in the European Union, the European Economic Area, or the United Kingdom.
You are responsible for the accuracy of the information you give us, for keeping access to your email account secure, and for everything done with your account. Tell us at support@dtcfitness.com if you believe your account has been used without your permission. You may hold only one account and may not create an account for someone else.
3. Your license to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your own non-commercial use.
You may not:
- copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer or attempt to extract its source code, except where the law expressly permits it;
- access the Service by automated means, scrape it, or interfere with or disrupt it or its security;
- access another user's data or account;
- use the Service to break the law or to infringe anyone's rights;
- resell, sublicense, or commercially exploit the Service or its content, including the exercise library.
4. Subscriptions and payments
Free and Pro. Core features of the Service are free. Some features (such as longer analytics and calendar history, workout export, and premium programs) require a paid Pro subscription or one-time purchase ("Pro"). The features included in Pro are described in the App and may change over time.
Purchases go through your app store. Pro is sold through the Apple App Store or Google Play, and your purchase is also governed by that store's terms. The price, billing period, and any free trial are shown before you confirm. Taxes may apply.
Auto-renewal. Monthly and annual subscriptions renew automatically at the end of each period at the then-current price, and your app-store account is charged within 24 hours before the period ends, unless you cancel at least 24 hours before it ends. A lifetime purchase is a one-time payment and does not renew.
Free trials. If an offer includes a free trial, your subscription begins and you are charged when the trial ends unless you cancel at least 24 hours before it ends. Trial eligibility is set by the app store.
Cancelling. Cancel in your device's subscription settings. For iOS, Settings → your name → Subscriptions; for Android, Google Play → Payments & subscriptions → Subscriptions. Deleting the App or your account does not cancel a subscription. After cancelling, Pro continues until the end of the period you have paid for.
Refunds. Payments are handled by Apple or Google, and refund requests go to them under their policies. We cannot issue refunds for app-store purchases directly.
Price changes. We may change Pro prices. The app store will notify you of any change to a subscription price as its rules require, and the new price applies from your next renewal.
Restoring purchases. If you reinstall the App or change devices, tap Restore on the Pro screen while signed in to the same app-store account.
5. Your content
"Your Content" is what you put into the Service: your profile, workouts, notes, body measurements, templates, programs you create, and the photos and videos you add. You own Your Content.
You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, and display Your Content only as needed to operate and provide the Service to you, and to create the images you choose to share. This license ends when Your Content is deleted from the Service, except for copies held briefly in backups as described in the Privacy Policy.
You are responsible for Your Content. You confirm that you have the rights to what you upload and that it does not break the law or infringe anyone's rights. We do not review Your Content, but we may remove content that violates these Terms.
Sharing. When you share an image from the App (for example to Instagram or your photo library), the destination's own terms govern what happens to it there.
6. Our content and intellectual property
The Service, including its software, design, text, exercise library, demonstration images and videos, illustrations, programs, and the DTC Fitness name and logos, belongs to DTC Fitness or its licensors and is protected by intellectual-property laws. These Terms grant you no rights in it other than the license in §3.
If you send us feedback or suggestions, we may use them without restriction or obligation to you.
7. Third-party services
The Service relies on third parties, including Apple, Google, and the service providers named in the Privacy Policy. We are not responsible for third-party services, and your use of them may be subject to their own terms.
8. Changes to the Service
We are continually improving the Service and may add, change, or remove features, including features in Pro. If we remove a material Pro feature during a period you have paid for, you may contact us and we will work with you, including by supporting a refund request to your app store. We may also suspend the Service temporarily for maintenance or security.
9. Ending these Terms
You may stop using the Service at any time and delete your account under Profile → Privacy & security → Delete account. Deletion is described in the Privacy Policy.
We may suspend or terminate your account if you materially or repeatedly breach these Terms, if we must do so to comply with the law, or if your use creates risk or legal exposure for us or other users. Where reasonable, we will tell you first and give you a chance to fix the problem. If we terminate your account without cause, we will support a pro-rata refund request for any prepaid Pro period.
Sections 1, 5 (last two paragraphs), 6, and 10 through 16 survive termination.
10. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure; that calculations, statistics, records, or suggestions will be accurate or suitable for you; or that data will never be lost. Keep your own records of anything you cannot afford to lose.
Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
11. Limitation of liability
To the fullest extent the law allows:
- DTC Fitness and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from or related to the Service or these Terms; and
- our total liability for all claims arising from or related to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) US $50.
These limits apply whatever the legal theory and even if we were told the damage was possible. They do not limit liability for gross negligence, willful misconduct, fraud, or anything else that cannot be limited by law, including personal injury caused by our negligence where that liability cannot be excluded.
12. Indemnity
To the extent the law allows, you will indemnify and hold harmless DTC Fitness and its members, managers, employees, and agents from claims, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your misuse of the Service, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the State of New Jersey and applicable US federal law, without regard to conflict-of-laws rules. Subject to §14, disputes will be resolved exclusively in the state or federal courts located in Bergen County, New Jersey, and you and we consent to their jurisdiction.
14. Dispute resolution and arbitration
Informal resolution first. Before starting any claim, email support@dtcfitness.com with your name, account email, and a description of the dispute and the relief you want. We will try in good faith to resolve it within 60 days.
Binding arbitration. If we cannot resolve it, you and DTC Fitness agree that any dispute arising from or related to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. The arbitrator may award the same individual relief a court could. Arbitration fees are allocated as the AAA Consumer Rules provide.
Exceptions. Either of us may bring an individual claim in small-claims court, and either of us may seek relief in court for infringement or misuse of intellectual property.
No class actions. You and DTC Fitness may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, or representative proceeding, and the arbitrator may not consolidate claims. You and DTC Fitness waive any right to a jury trial. If this class waiver is found unenforceable for a claim, that claim must proceed in court under §13, not in arbitration.
Opting out. You may opt out of this arbitration agreement by emailing support@dtcfitness.com, from your account's email address, within 30 days of first accepting these Terms, stating that you opt out of arbitration. Opting out does not affect any other part of these Terms.
Time limit. To the extent the law allows, any claim must be brought within one year after it arises.
15. Apple App Store terms
If you downloaded the App from the Apple App Store, the following also apply:
- These Terms are between you and DTC Fitness only, not Apple. DTC Fitness, not Apple, is solely responsible for the App and its content.
- Your license to the App is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent the law allows, Apple has no other warranty obligation for the App.
- DTC Fitness, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to meet a legal or regulatory requirement, and consumer-protection or privacy claims.
- If a third party claims the App or your possession or use of it infringes their intellectual property rights, DTC Fitness, not Apple, is responsible for the investigation, defence, settlement, and discharge of that claim.
- You represent that you are not located in a country subject to a US government embargo or designated as "terrorist supporting", and that you are not on any US government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
16. General
- Changes to these Terms. We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you in the App or by email before they take effect. Continuing to use the Service after that means you accept the new Terms. Changes do not apply to disputes already notified under §14.
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- Severability. If any provision is found unenforceable, the rest remains in effect.
- No waiver. Not enforcing a provision is not a waiver of it.
- Assignment. You may not transfer these Terms. We may assign them in a merger, acquisition, or sale of assets.
- Notices. We send notices to your account email or in the App; you send notices to support@dtcfitness.com.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
